Recently I attended a lunch presentation by a law firm that represent architects, engineers, and surveyors through construction related lawsuits. There is a lot to be weary of in the industry, particular for architects who may have no influence on the installation techniques of building materials, though are still liability for their integrity. Here are some notes from the talk:
Errors and omissions law- Arch, Engineers, Surveyors
Construction defect litigation
Means and Methods
Site Observation versus Site Inspection (Inspection $$, requires higher level of obligation), Drone inspection?!
Client-Arch-Builder GC (pyramid), Building officials
HOA owns from inner wall out
Colorado construction defect action reform act (CDARA)
Negligence, Violation of building code
Representations (do not make recommendations): offer 3 certified installers options for client to interview. Don't bear responsibility for installers actions.
